Thinking of starting an NGO? Here’s some advice from a few experienced NGO leaders.

  • NPOs (Non-Profit Organisations) are not for profit, so giving should be in your DNA otherwise you won’t last. Have passion for whatever the cause you are standing for and give your heart and soul to it.

    I am a 68yr old pensioner wanting to start a recycling initiative in a small relatively poor community in Pietermaritzburg. Together with my African partner, we have further identified a piece of derelict land which we would like to turn into a community playground and recreational area.
    Would we be in a position to apply for an NPO on these programmes.

    I hope you will help me as well. I started doing food parcels and giving to the needy a year ago. I normally used my money. I also send info to my colleagues to assist with as little as they can. Not much response but I’m still continuing. I battle to do food parcels every month. Got very few people that donates. Tried going to food retailers but they can’t help an individual who isn’t registered. They wanted a registered organisation.
    My dream is to do it every month. But with the lack of funds I can’t. Now which organisation should i register so I could get proper funding.

    I have been thinking about opening an orphanage. My train of thought would be to go the NGO route, is this the best option? I do not intend on relying on public contributions for running the orphanage- I am planning on setting up ways to have constant income to run the place. Is there a way to have a “private” NGO? Additionally, I have been struggling to find the the rules and regulations for orphanages in SA – have checked government gazettes, contacted child welfare but no one can point be in the right direction – I want to do this 100% by the book and not leave any registration with relanvant bodies incomplete.     I know you’ve answered this question several times, I read through all the comments and your replies. I just want to confirm, if i was to work with local donations or with my money using the term NGO (as you mentioned there is no registration process for an NGO) until my organization grows enough to be registered, would it put me in any legal trouble?
    I plan on starting my project exclusively online for now, considering the current situation with COVID-19 and later continuing work on a community level until the organization grows enough.
    I am a medical intern and I have a 2 year experience of working with a non-profit organization. My work will mainly be based on human health and rights awareness.
    I want to ensure that registration of an NGO is not an absolute requirement because up until now any resource I came across emphasizes on registration. And I do not want that to be an obstacle since it isn’t possible for me to obtain any registration for now due to the pandemic.
    It would be very kind if you could please provide a clarification. Thanks!

Thank you so much, and thank you also for taking the time to read before asking your questions 🙂 As mentioned, an NGO (the broad term for organisations doing charitable work) can operate without being registered. However, certain grants (eg. https://www.google.com/grants/) and related funding are only available to entities that are registered as an NPO/NPC. When dealing with donors, a formal registration as an NPO and/or NPC can provide additional credibility and accountability. Furthermore, donors to an NPC/ NPO/ charitable trust that is registered as a Public Benefit Organisation with section 18A status (https://www.sars.gov.za/ClientSegments/Businesses/TEO/Pages/default.aspx) will receive a tax rebate. Registering an NPO can be done online, and does not cost anything. Here are more resources that may be helpful to you: https://eluminationsa.wixsite.com/learn/blog Also just to note that depending on the service you are offering, you may also just need to check what regulations there are in relation to those. Health and rights awareness services may not require certain registration, whereas the provision of advice of a similar nature, might. I hope that this helps you in some way, and all the best.

They get paid, but I want to provide more opportunities by sourcing funding through donations. Would you advise me to open a separate NPO or I can use the existing private company to ask for donations? Is it legal and doable for private companies to ask for donations?       Hi Lizz. Thank you for your message. Please note that we are not an NGO advisory service, as this is not our main area of service. However, when dealing with donations, it is easier to have an NPC. In the USA and UK they have hybrid/ combined company structures that allow for a middle-ground between profit-making and non-profit (called social enterprises), but here nothing like that exists yet. So if you have a business, the main purpose of which is solving social issues, such as unemployment, then establishing an NPC is a good idea.     Hi, I would like to start a business in my community where I can teach the unemployed basic computer skills and offer Payroll courses.       The main aim of an NPO is serve the interests of its beneficiaries (the community/ group of people that it seeks to assist) whereas a for-profit company serves the interests of its shareholders, primarily. While an NPO may generate profits, these need to be put back into the operation of the NPO, not pocketed by those who run the NPO. A fair salary may be taken (https://eluminationsa.wixsite.com/learn/post/ngos-and-salaries-how-does-it-work), but the primary interests are always those of the beneficiaries that the NPO aims to serve – as stated in its constitution.       Hi Mondi, thank you for your message. The aim of a non-profit company (NPC) is primarily to benefit society, and proceeds made should generally be directed back to the cause. Running a business from an NPC for your own benefit, rather than for the beneficiaries that your NGO aims to serve, is therefore not possible – it would probably be better to register a company (PTY) LTD for this.     Hi everyone, very interesting insight. I also just started and NPO. If I had to map a blueprint, the first stop to open and NPO is to start an NPC (Non profit corporation) with the CIPC. At the CIPC you get a CC, a Trust, a PTY and you will NPC, choose a name, etc. Once you get the NPC registered, go to the Department of Social Development (DSD) to register your NPC as a NPO. You fill application forms, etc.

    Our focus is on the upliftment of the vulnerable groups of society. All provincial governments of South Africa have projects that they fund within this focus are depending where you are in the country.

    Hi, I am currently doing NPO work at my own expense, but I need to register something to make me legally able to collect donations. I am already transparent and believe in human rights, animal rights and accountability. Here’s my problem. I submitted an application for a NPO registration to Dept of Soc Dev NPO registrar. It has come back I need 9 board members.
    Why must I now find 6 more names to add to a board, just to make them happy. I want to be legal and make a difference, with a book keeper and an accountant, but NPO registration is for big established entities.bcan I do this another way. Could I register via SARS, what do you recommend.

I must start by saying that Different.org’s central focus is not NPO registrations and related matters – so the information we share is meant to provide guidance, but should in no way be taken as expert advice. As far as we know, a voluntary association, trust and non profit company all require a minimum of 3 members, not 9.       Hi Thabo, apologies for taking a while to respond. My advice would be to do some research and see what other NGOs in your area also work with children. Arrange a call/ visit and chat to them about the process they followed to ensure that they were compliant. I hope that helps!

    Hi Simone.I am wanting to start a drug and alcohol,as well psychiatic care centre in the Durban area.There is an enormous problem with substance abuse and emotional wellbeing in our area.I want to know what I would be required to do,and to understand the in’s and out’s of NGO’s.I am asking if we as an NGO can provide treatment for those person’s able to pay for their own rehabilitation,or accept person’s who are on medical aid schemes and hospital plans to assist in our running costs.We would also require sponsorship or donations to set up this project,and ask for your advice on how to go about with this.We would also at a later stage want to seek sponsor donors who are in a position to sponsor a patient who is not in a position to pay for treatment themselves.Would we need to register,and if so with who?Also,would we need to liase with the Department of health at all?Please give me as much advice here as posible as I really would like to start as soon as possible.Thank you kindly.     I have spend some time in the psychiatric ward at Tygerberg Hospital for evaluation, 72 hours.In my experience there i learned that there’s a lack of activity, the patients are not at all exposed to any kind of exercise thus, spending all there time sleeping, the lack of fresh air is a great concern, the fact that meal times is so far apart and so little, concerns me as their energy levels will be low, apart from the fact that pharmaceutical drugs seems to be the only way to keep these people under control.As I have trained myself in soft music and dance I was hoping in bringing this as a tool to help them in a different form or way of understanding their situation and helping them to grow mentally and physically. This is only my first attempt of an NGO and have no clue as to what to do next, fundraising and otherwise. Im not only willing to give back, Im willing to give all i have 24/7. Please find this plea as important as i am.

    Hey thanks for the advice i have a heart for giving back and making a difference in other people’s lives my dreambis to start my own NGO as i see a strong need for it i wanna help kid from advantaged families and orphans by giving them love and my time helping with school work, provinding toys during the festive season, playing with them and lunch fr them jst make them feel love and donate clothes, toiletries and motivating them.

    Hi i am a working person who would like to open my own business,as i am always involve with youth and the community i would like to take it further before i decide to leave my job, did numerous events raising funds for local community clubs, which my children belong to .This Easter past i did a EASTER HUNT FOR 200 CHILDREN , running cost came out of my pocket and assistance from less than ten neighbors who donated.     I will like to register my project as an NGO , we basically distribute information about bursaries, learnerships, scholarships, to grade 12, students , we help grade 9 students with subject selections for grade 10 as these is important for the career their wish to pursue, and we give motivational talks from grade 9 to grade 12 students , as we visit different secondary schools in Bela-Bela municipality. Recently we have been visiting individual schools, we have located a offices where we can open a walk in information centre, self service and one on one assistance.

    Where can we start , I checked the CIPC and to me it seems you can register an NPO not an NGO. Please assist! Thank you in advance.

    Is it possible to start NGO when you have no cent and rely totally on donors?
    Is it easy to apply for a grant for a new NGO, are financial statements required for brand new NGOs applying for grants?

      Hi Betty, this is a tough question to answer… Unfortunately funding always helps, but if there’s a social need/ problem that needs to be addressed, something needs to be done. I would recommend starting by looking at the existing NGOs and whether or not they are already working to solve the issue you’ve identified. If not, approach potential volunteers and community members to see whether or not there’s support from them to start an NGO (i.e. are they willing to give of their time to help serve, and/or would they be willing to help the NGO financially). Regarding your question about grants – I’m not sure about this – you would have to visit the websites of the major grant organisations you’re hoping to approach for funding, and read their terms. I think for the more established grant agencies, financial statements would be required, but once again, please check this with the particular organisation you have in mind. I hope this helps!

      Hi Sbusiso, thank you for your question. As mentioned, an NGO is a broad name for any non-profit entity doing charitable work. So there are a number of options available – you can register as a charitable trust (which is done at the Master’s Office: http://www.justice.gov.za/master/m_pamphlets/2011moh_trusts.pdf), a non profit company (which is administered by the Companies and Intellectual Property Commission (CIPC) (more information here: http://www.cipc.co.za/index.php/register-your-business/companies/register-non-profit-company/).

      It is correct that the Department of Social Development (DSD) can only register an entity (which could be a trust or a non profit company, registered with the CIPC) as an NPO. Registration as an NPO enhances the credibility and transparency of the organisation as it is expected that a registered NPO must comply with the requirements of the NPO Act.

        The Department of Social Development issues certificates of registrations for both NPOs and NGOs. I have a certificate of registration from them as an NPO but I need one as an NGO. If I didn’t see such a certificate before I would have thought the NPO certificate was correct but I have seen a certificate that says “Certificate of Registration of Non-Governmental Organization.” How do I get this?

    I am a Life Coach for Kids in private practice and would like to start collecting funds for blankets, food and toiletries for needy children.
    I am thinking of approaching schools do do motivational talks for which I would charge a small fee to assist me in reaching my goals. I would also donate a percentage of the funds collected to the school itself. Do you think this would work?

If you haven’t already done this, perhaps partner with a local organisation serving needy children so that you can work together with them. Sometimes collaboration to strengthen pre-existing projects is even more helpful than starting a new initiative. To ensure donor accountability, you may want to register yourself as a charitable entity – a trust, non profit organisation or non profit company are all options. All the best with your plans!

    To answer your question, which is a good one, as there are so many abbreviations in this space:
    – An NPO (or Non Profit Organisation, if you want the full name) is an organisation that is registered with the Department of Social Development, who has given that organisation a registration number (known as an NPO number). If you are registered as an NPO, there are certain compliance requirements that must be met.
    – An NGO (Non Government Organisation) is a broad term used to describe any organisation which is not for profit. An NGO isn’t necessarily registered with any regulatory body such as the Department of Social Development (DSD) – it is a term used to define the role of the organisation, rather than its status (i.e. that confirms registration with the DSD or CIPC* see below)
    – Another term you might come across is NPC (Non Profit Company) – which is a not for profit organisation registered with the Companies and Intellectual Property Commission (*CIPC) – it is not necessary for an NPO to also be registered as an NPC, but it can be done. Reasons for also registering as an NPC may include increased accountability for donors – but one can always do this at a later stage, once the organisation has grown a little and you’re dealing with bigger donors.
